Richie Incognito calls Jonathan Martin his best friend on the Miami Dolphins -- and says he's worried about the teammate who's allegations of hazing got Richie suspended ... TMZ has learned.

Incognito talked today for the first time about the scandal ... with FOX NFL insider Jay Glazer. Sources on the FOX set tell us Incognito wasn't exactly apologetic for his actions -- but instead expressed deep concern about Martin's health since he left the team.

We're told Incognito was willing to answer any and all questions about the controversy -- including alleged threats against Martin's family members, forcing him to pay for team meals, and the infamous voicemail he left ... where he allegedly called Martin a "half n***a."

The interview will air during tomorrow's FOX NFL Sunday pregame show.

Founding Grateful Dead member Phil Lesh whipped out his boomstick in Central Park today ... but don't worry he wasn't arrested ... he was just laying down some sick grooves.

Lesh pulled off the surprise gig during the NYC Jazz & Colors event in the Park ... when he randomly started performing with some friends in front of around 30 people.

The 73-year old bassist played for about 30 minutes and even jammed out on the Beatles classic "Get Back" in between impromptu jazz sessions.

We're told J.B.'s people have been trying to find another hotel for him to stay at following his sold out show tonight -- but each establishment has told them no ... because all his fans will follow.

Our sources say Bieber's people have NO IDEA what they're gonna do yet ... and are scrambling to find a place for JB -- and 25 other crew members -- to stay.

A fan and close friend of Blink 182 was rushed to an L.A. hospital last night during the band's sold-out concert at the Hollywood Palladium -- after falling from a 2nd-story balcony inside the building, Blink's rep tells TMZ.

Witnesses described the mayhem on Twitter, saying the fan fell "face first" while Blink was playing "Dammit" and looked in rough shape after the accident. The fall was roughly 15-20 feet, but witnesses say he was responsive.

One witness who was standing under the balcony tells TMZ, the man landed right next to her and his body made the "gnarliest splat on the ground ... I can still hear the sound. It was awful." He didn't land on anyone. The witness says he had blood all over his face.

According to the rep, the fan is a "dear friend" of the band, but the rep wouldn't be more specific.

It's unclear how the fan fell, and whether his injuries are life-threatening. He's currently being treated at a local hospital. The rep says the band is in touch with the man's family.

Another said, "the fans of Flamengo wants to kill you, are already planning to invade his show to throw rocks at you."

Justin Bieber –- JACKS PATROL BICYCLE ... Immediately Busted [Video]

Justin Bieber jacked a bicycle from a security guard in a Vegas casino ... AND GOT CAUGHT BY A COUPLE OF GIANT GOONS ... and TMZ has footage of the entire botched heist.

It all went down at The Palms Casino Resort on September 14 ... when JB and his crew were in town to watch the Floyd Mayweather fight.

Bieber entered the building through an employee entrance and stumbled upon a patrol bicycle in the hallway -- so, he took it.

Security footage shows Justin joyriding the bike through the halls -- while a security guard chased after him in an effort to get the bike back.

Eventually, a couple of bigger security guys -- dressed in suits (so you know they're not f**kin around) -- cornered Justin in the hallway and forced the pop star to hand over the stolen property.

We're told security gave Justin a stern talking to and eventually let him go.

Joe pleaded the problem was with his accountant, not him.

Joe tells us -- his accountant acknowledged the screw up and made the account current ... so everyone's happy.

It's a ray of good financial news in a bleak financial forecast.-- Joe's company declared bankruptcy in February, and he's personally been ordered to pay Vegas casino mogul Steve Wynn $19 million .

Goonies never say die ... except when it comes to marriage -- TMZ has learned, "Goonies" star Robert Davi's wife has filed for divorce.

Davi's wife Christine filed the docs in L.A. citing irreconcilable differences. The couple was married in 1990 and separated this week after 23 years. They have two minor children, 12-year-old twins.

According to the docs, Christine wants legal and physical custody of the kids. She wants Robert to get visitation.

In addition, she wants Robert -- who also starred in movies like "Die Hard," "Showgirls," and "License to Kill" -- to pay her attorney's fees as well as spousal support.

We reached out to Robert for comment. So far, no response.

'Amish Mafia' Star Esther Schmucker -- Fugitive Boyfriend Nabbed In Vicious Beating

The boyfriend of "Amish Mafia" star Esther Schmucker is locked up in a Pennsylvania prison for allegedly using the reality star's face as a punching bag ... and then trying to shut her up.

Imir R. Williams was captured by a police task force in Lancaster, PA this morning ... he'd been hiding out since Sunday when cops named him the suspect in Esther's beating -- which left her with a broken nose and cheekbone.

Schmucker reportedly went to a hospital for treatment after last Thursday's attack -- accompanied by Williams. Her roommate told police Williams was "guarding her" to make sure she didn't rat him out.

But cops say Schmucker did eventually come forward 3 days later to tell them about the alleged attack.

Williams is being held in the Lancaster County Prison on $250,000 bail.

'20/20' Anchor Elizabeth Vargas In Rehab for Alcohol Abuse

“20/20” co-anchor Elizabeth Vargas has been MIA for weeks ... and now we know why -- she's been in rehab for alcohol abuse.

Vargas checked into rehab a couple weeks ago -- according to the NY Daily News -- and will remain in treatment for a few weeks more. She'll return to "20/20" when she's released from the rehab facility.

Vargas released a statement saying she suffers from addiction, claiming, "I realized I was becoming increasingly dependent on alcohol. And I feel fortunate to have recognized it for the problem it was becoming."

She adds, "Like so many others, I will deal with this challenge one day at a time."

ABC says it fully supports her and looks forward to welcoming Vargas back.

Josh Altman – star of "Million Dollar Listing" – crashed his Range Rover into some prime real estate this morning ... the House of Blues on Sunset Blvd. ... TMZ has learned.

We know ... at least 3 cars were involved in the accident -- and several witnesses are saying it was all caused by a 4th car that made a dangerous turn across busy Sunset Blvd. traffic.

TMZ spoke with Josh's brother Matt who tells us ... the dangerous turn caused the driver of a red Honda to slam on the brakes. The Honda was hit by a taxi van, which was hit by Josh's Range Rover.

We're told Josh tried to swerve around the taxi ... but ended up clipping the car and slamming into the House of Blues.

Cops responded to the scene. We're told they're currently looking into the situation.

Fortunately, Josh didn't appear hurt in the crash and nobody involved suffered any serious injuries.

As for the HOB, we're told management is making plans to repair the damage ASAP and no shows will be cancelled as a result of the incident.

Ignorance of the law is no excuse, unless you're Justin Bieber -- because that's what he's claiming now that police are trying to contact him in connection with illegal graffiti in Brazil.

Bieber was photographed tagging up a Rio building Tuesday, and local police reportedly launched an investigation ... even going to Bieber's rented mansion to question him, but the singer was gone by the time cops arrived.

FYI, defacing buildings is a crime in Brazil punishable by up to a year in jail ... and thanks to these photos, police now have reason to believe Bieber is guilty.

But sources close to the Biebs tell us, the singer is pleading ignorance, insisting he was advised by locals to tag the buildings in question -- and presumed it was okay.

Not like it matters now, we're told Bieber has since left Rio and probably won't be back for a while.

You'll recall, Bieber's been on a tagging frenzy in South America -- just last week he was spraypainting the phrase "Free Breezy" in Colombia.

Michael Moore -- Guns Don't Kill People ... Americans Kill People

Michael Moore says he wasn't shocked by last week's shooting at LAX ... saying gun attacks are just part of the "country we live in."

Moore was at LAX -- the very site where Paul Ciancia opened fire on TSA workers on November 1, killing one and injuring several other people -- when he was asked about the gun violence that's taken place in our country since he released "Bowling for Columbine" in 2002.

"Nothing changes ... it's the country we live in," Moore said ... "Legally purchased gun, bullets."

"There's a reason why this doesn't happen in Canada in Ireland in France ... they have the occasional craziness, but it's not on a weekly or monthly basis."

Moore concluded -- "I think the N.R.A. they got it half-right when they say 'Guns don't kill people, people kill people.' I change it to 'Guns don't kill people, Americans kill people."

He added ... "Why?"

Tom Cruise is declaring he's a damn good dad to Suri ... opening up for the first time about his divorce from Katie Holmes and how it affected his relationship with his daughter.

Cruise just filed docs in his $50 million lawsuit against the publishers of "Life & Style" and "In Touch" magazines for cover stories that claimed he "abandoned" Suri after divorcing Katie in June 2012.

In the docs, Cruise says ... "I have in no way cut Suri out of my life -- whether physically, emotionally, financially or otherwise."

He goes on to cite specific times he saw his daughter in person in the months following the divorce, and says ... "even during the times when I was working overseas and was not able to see Suri in person, we were (and continue to be) extremely close."

The docs are pretty revealing ... since Tom has said next to nothing publicly about the divorce from Katie.

Cruise admits he was busy shooting 2 movies when "In Touch" ran its headline, "Abandoned by Daddy" -- however he says, "As my numerous emails with Suri's mother during this time period demonstrate, I was a constant presence in Suri's life."

Tom's declaration continues ... "While I'm sure my daughter misses me when I am not with her (as I miss her), she is a very happy child, and we have a wonderful relationship and cheerful phone calls."

"Amish Mafia" star Esther Schmucker was allegedly beaten to a pulp by her boyfriend last week in Pennsylvania -- suffering a facial fracture, broken nose, and more -- and now police are trying to track the man down.

According to reports, cops in Strasburg, PA issued a felony arrest warrant for 24-year-old Imir R. Williams on Sunday. Williams has been charged with felony aggravated assault in connection with the alleged beating.

Police claim Williams attacked 27-year-old Schmucker early Halloween morning, repeatedly punching her in the head.

In addition to the face fracture and broken nose, police claim Schmucker suffered broken cheekbones and several broken teeth.

As of this morning, police were still searching for Williams, who's described as 6'4" and 210 pounds. Authorities believe he's either in Lancaster or New Jersey.

Schmucker has reportedly attempted to obtain at least three protection-from-abuse orders against Williams in the past, but they all expired because she failed to show to any court hearings.

A rep for the singer didn't know if Babyface was inside when the fire started ... but we're told the house was occupied.

No word on what started the fire.
