TMZ Sports broke the story ... Churchill Downs is asking Welker to pay back the $15k they accidentally overpaid him due to a machine malfunction at the track on May 3rd.
But Philips -- who played with Welker on the Broncos last year -- says if he were in Welker's shoes, he would return the cash ASAP.
One of Shaun's friends has a different take on the situation -- and says he would keep the money -- but Shaun wouldn't budge in his position.
As far as the law is concerned, we spoke to a bunch of experts in gambling law in Kentucky and they all said the same thing ... Welker will probably have to pay the money back.
As far as Welker's concerned ... he told the track, "Get in line. "

A rep for the Orange County Sheriff's Office in FL tells TMZ, the three suspects were arrested Monday evening outside the 12,300 square foot 6-bedroom mansion ... after cutting through the fence.
Police say the men were dressed in all black ninja-type outfits and were carrying backpacks containing zip ties, duct tape, and handguns. According to police, one of the suspects fled and hid in nearby bushes ... but was quickly sniffed out by a K-9.
Cops believe the burglars are the same perps who burglarized a nearby home last month ... also dressed as ninjas. That break-in was caught on tape (above).
Either way, the ninjas ain't Fatone's problem -- he sold the house in 2011 ... for $3.9 million.
Kim Kardashian -- Elevator Police!!!
Our photog peppered Kim with wedding questions as she made her way to the elevator, but she didn't utter a sound. But Kim had no problem opening her mouth when it came time to banish the gaggle of photogs who magically appeared in her elevator. It was really quite funny.

Casey Kasem Found in Washington State

Kasem was found in Washington state, three days after a Los Angeles judge expressed concerns about the iconic radio host’s whereabouts.
Santa Monica police Sgt. Mario Toti said Kasem was located by the Kitsap County Sheriff’s Department on Wednesday. Kasem's children had filed a missing person's report earlier in the day.
The "Top 40" host has been in poor health in recent years. Kasey's wife Jean had been in control of his medical care and had blocked his three children from a previous marriage from seeing him.
The ongoing dispute between the two sides will resume in court on June 20.

The jig is up for the woman who accused Justin Bieber of attempted robbery this week -- an employee at the L.A. batting cage where the incident occurred tells TMZ, Bieber NEVER tried to rob anyone ... he never even touched the woman.
The Sherman Oaks Castle Park employee called in to "TMZ Live" moments ago, claiming she witnessed the heated exchange Monday night between Bieber and the woman who was taking photos of him.
The employee says the woman was definitely the instigator, being overly aggressive and ignoring security's requests to stop snapping pics. She says Bieber was upset, but never got physical with the woman in any way ... and definitely didn't try to grab her phone .
Sources close to Bieber tell us, the singer lost his cool because the flash kept distracting him while he was trying to bat.
The employee says surveillance video would back her up -- but it's unlikely the security cameras caught what happened ... the incident was too far away.
Hedo Turkoglu -- Please Pray for Turkish Miners
L.A. Clippers player Hedo Turkoglu is calling for prayers for the 201 people killed in a mining accident in his native Turkey this morning ... saying, "No words for our sadness today."
Turkoglu -- who was born in Instanbul and played for the Turkish national team -- went to Twitter moments ago and wrote, "201 miners killed in an accident in Soma /Turkey , pls keep our miners and their families in your prayers."
More than 700 people were inside the mines when a fire broke out just a few hours ago. At least 201 people were killed ... and officials say there could be more than 100 people still trapped inside.
Jay Z -- LAPD Kills Extortion Investigation Over $20 Million Master Recordings

TMZ broke the story ... producer Chauncey Mahan was detained by police last month after Jay's people accused him of stealing the master recordings for several big Hova songs back in 2002 -- and then trying to hold them ransom ... for a $100,000 "storage fee."
LAPD confiscated the recordings pending the result of a criminal investigation, but law enforcement sources now tell us, Jay Z's camp has decided NOT to pursue extortion charges. As a result, the LAPD will no longer be investigating. Case closed.
But the tale of the tapes isn't over -- we're told the LAPD will continue to hold on to the recordings until a civil judge tells them to do otherwise.

We broke the story ... Stiviano was involved in a fender bender in Beverly Hills Monday afternoon ... and went OFF on the other driver, cussing her out and shouting things like, "You know who you're messing with, motherf*****?"
The other driver told us Stiviano was at fault -- failing to stop as she pulled her Ferrari into a parking lot and slamming into the back of the other driver's Range Rover -- but the video tells a much different story.
In the clip, you can clearly see the Range Rover is actually the one responsible -- REVERSING INTO Stiviano ... and tapping her front fender.
If only Donald Sterling got that much action.
